The Volkswagen Emissions Test Scandal Affects UK Owners

Car manufacturer Volkswagen could face a barrage of legal claims from British car owners following the recent emissions tests scandal.

Already law firms have received a large number of enquiries from VW owners whose vehicles may have been far more polluting than claimed after the German car maker admitted installing “defeat” devices, (computer software which turns on emissions control systems when a car is being tested but not during normal driving), to manipulate engine tests in Europe .

The VW group is already facing criminal investigations in the USA and other countries, plus potential legal claims worldwide, with 11m vehicles directly affected.

Owners and car dealerships in the UK may have viable legal claims for breach of contract, with the value of vehicles falsely boosted by VW's misrepresentations. Owners, many of whom would have paid a premium price for a “greener” vehicle, should not expect to claim back the whole value of their car, rather recompense for its fall in value – on average thought to be £2000.

Compensation may also be sought for increased spending on fuel, lower re-sale values, out of pocket expenses and any increase in road tax due to higher pollution levels.

Shareholders might also have a case for compensation after the 30% fall in the company's share price since the scandal erupted.
