Make your wishes clear in a Will and spare your loved ones anxiety

Release date: May 2009

From 1st Feb 2009, the 'statutory legacy' (the amount going to your legal spouse or legal civil partner) under intestacy has been increased:

  • Where there are children the legacy has increased from £125,000 to £250,000
  • Where there are no children the legacy increased from £200,000 to £450,000

Justice Minister Bridget Prentice said: 'Married couples and civil partners should not assume that when their spouse or civil partner dies, they will automatically be entitled to everything. It is up to individuals to make sure that their wishes are respected by making a Will. My message to people is, don't leave it to chance. Make sure your loved ones are properly provided for by leaving a Will'. Many do not realise that any assets valued above the statutory legacy, which includes property, do not go to the spouse but to other relatives. . A Will can be drawn up for as little as £120 +VAT- perhaps a small price to pay to make sure your loved ones are protected?
